Effective [EFFECTIVE DATE] ยท Version 1
1. Who we are
TaskStrider is run by TaskStrider LLC, a Pennsylvania limited liability company ("we," "us"). These Terms are an agreement between us and the business that signs up (the "shop"). "Users" means the managers and employees a shop adds to its account.
2. Agreeing to these Terms
The shop's owner agrees to these Terms by checking the box when signing up or, for a shop set up in person, before its free trial starts. We save the date, time and version agreed to. The person who checks the box must be at least 18 and have the authority to sign for the shop.
If you don't agree, don't use TaskStrider.
3. What TaskStrider does
TaskStrider is a web app with a job board and employee scheduling: shifts, published schedules, notices, availability, open shifts, call-offs, shift swaps and time off. We may add, change or remove features over time.
TaskStrider sends emails about accounts and the app, such as notices to managers, sign-in links and billing. Employees see their notices in the app. By using TaskStrider, users agree to receive them. We don't send marketing emails to employees.
4. Who can use it
- The shop decides who gets access and adds its own managers and employees.
- Employees must be at least 14 years old. No one under 13 may ever be added.
- The shop is responsible for everything its users do in its account.
- Users must keep their PINs private. The shop must remove people who leave.
5. The shop's responsibilities
TaskStrider is a scheduling tool. It does not check schedules for legal compliance, track hours for payroll, or serve as an official time record. The shop is responsible for:
- Following all employment laws, including wage and hour laws and Pennsylvania's child labor laws (work permits and hour limits for employees under 18).
- The accuracy of its schedules, time off and records.
- Having the right to enter its employees' information into TaskStrider, and telling them it uses TaskStrider.
6. Acceptable use
No one may use TaskStrider to:
- Break the law or help anyone else break it.
- Harass, threaten or abuse anyone, including through notices.
- Attack, overload, probe or try to break into the app or other shops' accounts.
- Copy, resell or reverse-engineer the app, or share access with another business.
7. Free trial, price and payment
- New shops get one 30-day free trial. A card is required to start it. Unless the shop cancels before the trial ends, the first charge is on day 31 and then every month after. A shop that signs up online and doesn't add a card within 7 days, or is set up in person and doesn't add one within 30 days, is deleted.
- After the trial, the price is $49.99 per month per shop, with every employee included.
- Payment is due monthly, in advance. Payment is by card through Stripe, our payment processor.
- Sales tax is added where the law requires it.
- Founding shops keep their founding price as long as they stay subscribed without a break. A founding shop that cancels and returns later pays the current price.
8. Price changes
We give at least 30 days' notice by email before a price change takes effect. Founding shops keep their price as described in section 7.
9. Late payment
If a payment is missed, the shop's account becomes read-only. Users can view everything but can't make changes. If the payment isn't made within 14 days, the account is cancelled. A shop billed by arrangement follows that arrangement.
10. Cancelling and refunds
A shop can cancel any time. It keeps full access until the end of the month it already paid for. We don't give refunds for part of a month.
11. The shop's data
- The shop owns the information it and its users put into TaskStrider.
- The shop lets us store and use that information only to run TaskStrider for it.
- We never sell it and never use it for advertising.
- We may use combined, anonymous totals (for example, how many shifts are built each week) to improve TaskStrider. These never identify a shop or a person.
- We only look inside a shop's account to give support, fix a problem, or deal with a security issue.
- Our Privacy Policy explains this in more detail.
12. Deletion after cancelling
We delete a shop's data 30 days after its account is cancelled, except the records our Privacy Policy says we keep. Until then, the shop can download its jobs and hours as spreadsheets. Copies in our encrypted backups are gone within 90 days of cancelling.
13. Suspending or closing accounts for misuse
We may suspend or close an account that is used illegally, to harass anyone, or to attack the app. We warn the shop first, unless the problem is urgent or illegal.
14. Availability
We work to keep TaskStrider running, but we don't guarantee it will always be available or free of errors. It may be down for maintenance or problems outside our control.
15. No warranties
TaskStrider is provided "as is" and "as available." To the extent the law allows, we make no promises beyond those written in these Terms.
16. Limit of liability
To the extent the law allows:
- Our total liability for any claim is limited to what the shop paid us in the 12 months before the claim.
- We are not liable for lost profits, lost business, missed shifts, lost or damaged data, or other indirect losses.
17. The shop covers its own misuse
The shop agrees to cover our costs, including reasonable legal fees, if someone makes a claim against us because of the shop's misuse of TaskStrider or its breaking employment laws.
18. Changes to these Terms
We email the shop at least 30 days before a real change takes effect. Small fixes, like typos, take effect right away. A shop that keeps using TaskStrider after the 30 days has accepted the change.
19. Pennsylvania law and disputes
Pennsylvania law governs these Terms. Any dispute goes to the courts of Clinton County, Pennsylvania, including the local magisterial district court for small claims.
20. Other terms
- These Terms and the Privacy Policy are the whole agreement between us.
- If a court finds part of these Terms unenforceable, the rest still applies.
- A shop can't transfer its account to another business without our written okay. We may transfer these Terms if TaskStrider is sold.
- We send notices to the email address on the shop's account.
